Terms of Service

1. Acceptance of Terms

By accessing or using Second Set Health ('Second Set,' 'we,' 'our,' or 'us'), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform. These terms apply to all visitors, patients, caregivers, and healthcare providers who access the platform.

2. Description of Service

Second Set is a personal health record and patient advocacy platform designed to help individuals organize, understand, and share their health information. The platform provides tools for recording medical history, tracking medications, managing appointments, optional AI-assisted research and note helpers, and communicating with your care team. Some marketing descriptions (for example, direct hospital EMR connections) may reflect pilots, waitlists, or phased rollouts rather than immediate availability for every user. Second Set is not a substitute for professional medical advice, diagnosis, or treatment.

3. Medical Disclaimer

Second Set is not a licensed medical provider. The information and tools on this platform are for informational and organizational purposes only. Nothing on this platform constitutes medical advice. Always seek the guidance of your physician or other qualified health professional with any questions you may have regarding a medical condition or treatment.

4. Eligibility

You must be at least 18 years of age to create an account. By creating an account, you represent that you are at least 18 years old and that the information you provide is accurate and complete. If you are creating an account on behalf of a minor, you represent that you are the legal guardian of that minor.

5. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. You are responsible for all activity that occurs under your account. Do not share your login credentials with others; use caregiver access features for family members who need visibility into your records.

6. Health Information & Privacy

We take your privacy seriously. All health information you enter is stored securely and encrypted at rest and in transit. We do not sell your personal health information to third parties. Automated processing (including AI outputs) may be used to assist you; outputs can be wrong or incomplete and must be reviewed by you and your clinicians. Your data is governed by our Privacy Policy and HIPAA Notice, both of which are incorporated by reference into these Terms.

7. Caregiver Access

Patients can grant caregiver access using the in-app sharing controls and revoke an active grant from the portal. Each adult uses their own account. Access is limited to the information and permissions the patient grants; do not share passwords. Revoking access stops future access through that grant but cannot retrieve information already downloaded or copied by its recipient.

8. Electronic Health Records and External Connections

Where offered, connections to external electronic health records are intended to use industry-standard authorization flows (such as SMART on FHIR) and granular consent. Until such connections are available to your account, you may upload visit paperwork and enter information manually. Imported data remains in your account until you delete it.

9. AI-Assisted Features and Visit Audio

Optional features may send content you provide (including audio for visit helpers) to subprocessors for speech-to-text and summarization. We design processing so raw visit audio is not retained as a long-term medical record after processing; persisted content is generally the transcript and notes you choose to keep. You should treat AI-generated text as assistive, not authoritative.

10. Provider Use

Healthcare providers who register on Second Set agree to use the platform only for lawful purposes and in compliance with applicable law, including HIPAA. Providers may not access patient records without appropriate authorization. Provider accounts may be subject to additional verification.

11. Subscriptions and Billing

Second Set offers new patient accounts a 7-day free trial with full access. After the trial period, continued access requires a paid subscription; your data is retained, and account settings and data export remain available without subscribing. Subscriptions are billed monthly or annually. You may cancel at any time. Refunds are governed by our refund policy, available upon request. Billing is handled securely through Stripe.

12. Intellectual Property

All content, design, and software on this platform is the property of Second Set Health, Inc. and is protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works without express written permission. Your health data remains your property at all times.

13. Prohibited Conduct

You agree not to: use the platform for any unlawful purpose; attempt to gain unauthorized access to any part of the platform or another user's account; upload or transmit viruses or other malicious code; impersonate any person or entity; or use automated means to access the platform without our express permission.

14. Limitation of Liability

To the fullest extent permitted by law, Second Set Health, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform. In no event shall our total liability exceed the amount you paid for the service in the three months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Second Set Health, Inc., its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

16. Termination

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms. You may delete your account at any time from your account settings. Upon termination, your access to the platform will cease, and we will handle your data in accordance with our Privacy Policy.

17. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or an in-app notification. Continued use of the platform after changes are posted constitutes acceptance of the revised terms. The date at the top of this page reflects when these terms were last updated.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
